These terms and conditions are for the ordering, purchase, fulfillment and delivery of products from Curtain Express Pty Ltd., through the website www.curtainexpress.com.au.
Within these terms and conditions, ‘We’, ‘Us’ or ‘Our’ refers to Curtain Express, while ‘You’ or ‘Your’ refers to one of whom uses this website. Your access to and use of the information on this website, including the purchase of our products, is subject to these terms and conditions, by which you are entering into a legally binding agreement with Curtain Express.
Please read these terms and conditions carefully before placing your order as the terms and conditions contain important information about policies, acquiring our goods and limitations of liability.
We reserve the right to amend these terms and condition at any time without notice. Your use of the website following these amendments mean that you accept the new terms and conditions and are bound to them. Therefore it is recommended by us that you read the terms and conditions each time you use this website.
These terms and conditions are intended for Australian residents only.
1. Registered Users
1.2 Upon registration, you agree that the personal details you provide are true and accurate at all times and that upon any circumstantial changes, you update your registration details once they change.
1.3 You are required to provide a password and email upon registration. Upon registration you agree to pay for our goods and services on our website.
1.4 The services we provide are intended for registered users who are residents of Australia only.
1.5 We reserve the right to terminate your registration at any time if you breach these terms and conditions.
2. Legal Capacity
2.1 Only those who are over the age of eighteen (18) years are allowed to place orders with Curtain Express. By accepting this term, you acknowledge that you are over the age of eighteen (18) years.
3. Website Use
3.1 The website may contain hyperlinks to other websites. The links provided are for convenience only and are not guaranteed to be current or maintained. We are not responsible for the linked websites, their content or their privacy policies.
3.2 You must ensure that your access to, or use of the website does not breach any laws that apply to you.
3.3 When accessing and using the website, you must take your own precautions to protect yourself from the possibility of risk of viruses, malicious computer codes or other forms of interferences, which may be detrimental to your computer system. While we take due care in ensuring our website is free of such factors, we are not responsible for any damages that may be incurred from your use of our website.
4.1 We reserve the right to change prices displayed on the website without notice at anytime. If you have placed an order, we will endeavor to fulfill your order at the price displayed at the time your order was placed.
4.2 All prices are in Australian Dollars (AUD) and aim to make sure our displayed prices are current.
4.3 All prices displayed on the website exclude delivery costs. Delivery costs will be shown separately on your order.
5. Product Descriptions
5.1 We aim to provide the most accurate description possible for our products. We do not, however, guarantee that the descriptions are accurate, therefore, all dimensions of our product descriptions on the website have a 5% tolerance.
5.2 We reserve the right to change any product descriptions at any time without notice. Where we become aware of any discrepancy between a product and its description, we reserve the right to correct any error or omission without notice.
5.3 Images provided on the website are for illustrative purposes only. We do not guarantee that the images will give a true and accurate idea of colour or design relating to that product, nor so we guarantee that these depictions will translate to the tangible product.
6. Product Orders
6.1 We aim to make sure that our product list is current at the time of your order, however we give no guarantee to the availability of any products shown on our website.
6.2 When you place an order with us, we require your name, email address, telephone number, address for delivery and your payment details. Whilst we pledge to take care of this information, once you have provided us with the information, you accept that we hold no liability for its misuse as a result of error in transmission, virus or malware.
6.3 It is your responsibility as a customer to provide the correct contact details with your order to ensure that seamless correspondence between the two parties can occur.
6.4 Orders will be deemed to have been received by Curtain Express once we send a confirmation email detailing your order to your nominated email address.
6.5 Curtain Express may cancel your order at anytime prior to the dispatch of the products. We are not required to give reason for our cancellation, however it would most likely be as a result of not having that product in stock.
6.6 In the event of Curtain Express cancelling your order, money paid for that order will be refunded to you in full. You will receive a confirmation email detailing the cancellation and refund.
6.7 Once you have placed your order, you may not cancel that order.
6.8 Curtain Express does not accept any responsibility for orders that are not processed, declined, or delayed as a result of malfunctioning internet connection.
6.9 Title in the goods passes to you once we have received payment.
6.10 Risk or loss or damage to the goods passes to you once we have dispatched the products.
7.1 We accept a variety of payment methods including PayPal, Visa, Master Card direct bank transfer.
7.2 Payment for orders will be processed immediately upon confirmation of your order.
8. Order Cancellation Due to Error
8.1 Curtain Express reserves the right to cancel any transaction where the ordered product is priced, described or photographed incorrectly as a result of a typographical error. We will immediately refund you for the total amount debited.
9. Delivery and ownership of goods
9.1 We aim to ensure that all of our products are delivered in a prompt and reasonable timeframe (please see out Shipping Policy). However, occasionally delays in the delivery process may occur as a result of shipping issues and other factors beyond our control. Curtain Express does not accept any liability for loss or damage suffered by anyone as a result of any delays.
9.2 The dispatch dates provided on the website and in our Shipping Policy is an estimated time frame, which is carefully estimated by Curtain Express. These dates can change without notice as a result of the possibility of unforeseen circumstances. Customers will be notified via the email provided with their personal information if the dispatch date is delayed by more than one week.
9.3 Products will be delivered during local business hours (9am to 5pm, Monday to Friday) by Curtain Express’ nominated courier or postal service.
9.4 Curtain Express recommends that you use a business address or other location for delivery to ensure that someone will be there to sign for the delivery between these hours.
9.5 Curtain Express is not responsible for the delivery time of your goods. Once the goods are dispatched, delivery is out of our control and the responsibility lies with the nominated courier or postal service. If goods are lost during delivery, this will have to be resolved with the courier company.
10. Product returns
10.1 If any product delivered to you is faulty or is in a damaged condition, we will replace it. If you wish to return any faulty or damaged products, please notify us through our ‘contact us’ webpage, where requirements for returning such goods are outlined.
10.2 If we are unable to replace or exchange your goods at the time in which they are returned, you will be reimbursed for the amount of the purchase, including packaging and postage charges.

11. Intellectual property
11.1 All material on our website, including any texts, layout and images is the property of Curtain Express. We therefore have a license to use this content. Unless you are expressly permitted under these terms and conditions, you may not copy, reproduce, republish, display or modify any material on this website without written permission.
11.2 Any comment made by you on the website becomes our property. ‘Comments’ include generic comments, ideas, suggestions and feedback. You therefore agree that by submitting Comments to our website, we are entitled to use them for any purpose at any time without compensation to you.
12.1 To the extent permitted by law:
We will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise; and
our maximum aggregate liability for any Product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) in question.
13.1 By using our website, you agree to indemnify us from and liability, loss, costs, actions or damages that may occur from using our website.
1. Cancellation of orders is possible under the following conditions:
– If Curtain Express has not yet processed the order.
Orders are processed once we have received full payment. Once payment is received and has been confirmed, orders are processed within 1-6 hours for manufacturing (custom made products) or shipping (ready made products).
– If the order has not yet been processed by the manufacturers.
If we have processed your order but the manufacturer has not, orders still may possibly be cancelled. However, we would have to enquire with the manufacturing team prior to accepting a cancellation in this situation. Furthermore, the customer may incur incidental costs in this instance.
2. We strive to serve and satisfy our customers and aim to assist in any way we can. However, if the order has been processed both by the manufacturers, and us, orders cannot be cancelled.
3. We try to make our product descriptions as specific and accurate as possible to ensure that the customer is making the right choice for them. Please read these descriptions and specifications thoroughly before making your purchase to avoid the possibility of cancellations. If you are uncertain about anything, contact us and we will be able to help.
4. In the case of a cancellation, we require your:
– Full customer name
– Invoice number
You may cancel your order via email or telephone. Confirmation of the cancellation will be sent to the email address you provide us when purchasing your product/s.
5. Money will be refunded in the same channel it was paid in. Due to security reasons, we are not able to refund the customer in any channel other than the channel they initially paid through. The customer’s money will be refunded within 21 working days from once the cancellation is approved.
